1. Acceptance of Terms
By accessing and using this platform ("Platform"), operated by Pomera Services sàrl ("we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.
2. Description of Service
The Platform is a professional coaching and AI-assisted learning environment. It provides access to AI coaching assistants, learning resources, coaching documents, and session scheduling tools. The Platform is not a regulated medical, legal, or financial advisory service.
3. AI-Generated Content
The Platform uses artificial intelligence to generate responses, development plans, and recommendations. AI-generated content is provided for informational and coaching purposes only. It may contain errors or inaccuracies. You are solely responsible for verifying any AI-generated advice before acting on it. We make no warranties regarding the accuracy, completeness, or fitness for purpose of AI-generated content.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Share your account access with others
- Attempt to reverse-engineer, scrape, or disrupt the Platform
- Upload content that is defamatory, harmful, or infringes third-party rights
- Circumvent any access restrictions or subscription requirements
6. Subscriptions and Payments
Access to certain features requires a paid subscription. Trial periods, if offered, are subject to the terms communicated at sign-up. After your trial ends, you must subscribe to maintain access. Payments are processed securely via Stripe. All prices are in the currency displayed at checkout. Subscriptions auto-renew unless cancelled before the renewal date.
7. Intellectual Property
All Platform content, including AI models, interfaces, and coaching materials, is the property of Pomera Services sàrl or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Pomera Services sàrl shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
10. Governing Law
These Terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of material changes via email or in-app notice.
